Terms and conditions
Art. 1 – Subject
The present general conditions regulate access and use of accessible web sites through the following uri: dipavali.it, dipavali.org, giornatainternazionaledelloyoga.it, hinduism.it, induismo.it, internationaldayofyoga.it, teofonia.it, unioneinduista.it and relative subdomains from now onwards denominated web sites of property and managed by UNIONE INDUSTA ITALIANA – Via Arno 38 – 00198 Roma C.F. 05771411005 – from now onwards denominated administrator.
Access to the sites and their use, as well as the use of the services associated with them, presupposes the reading, knowledge and acceptance of the general conditions of use. The use of the sites constitutes a declaration of knowledge and acceptance of the general conditions.
Art. 2 – Changes to the conditions of use
The manager may modify or simply update, wholly or partially, the general conditions of use. Changes and updates to the general conditions of use will be notified to users on the Home page as soon as they are adopted and will be binding as soon as they are published on the websites in this section. The user who continues to use the services of the sites after the publication of changes to the conditions of use accepts the new terms without reservation.
Art. 3 – Intellectual property
The contents present on the sites, such as, for example, the works, images, photographs, dialogues, music, sounds and videos, documents, drawings, figures, links and any other material, in any format, published on the sites themselves, including menus, web pages, graphics, colours, schemes, tools, fonts and design of the sites, diagrams, layouts, methods, processes, functions and the software that are part of the sites are protected by copyright and any other intellectual property right of the owner or of any third parties contracted by the same. Reproduction, wholly or partially, in any form, of the sites and their contents, without the written consent of the owner is prohibited.
The User is only authorized to view the sites and their contents using the related services available there. Art. 4 – Use of the sites and user responsibilities
The access and use of the sites, the display of web pages, including communication with the manager, the ability to download information, the use of the applications contained therein constitute activities conducted by the user exclusively for personal uses unrelated to any commercial, entrepreneurial and professional activity.
The User is personally responsible for the use of the sites and their contents. In fact, the manager cannot be held responsible for any use of websites and content by any of its users that does not comply with current laws, without prejudice to liability for fraud and negligence. The user will be the one and only responsible for the communication of information and data that is incorrect, false or relating to third parties, without these having given their consent, as well as in consideration of incorrect use of the same.
Any material downloaded or otherwise obtained through the service is at the user’s choice and risk, therefore any responsibility for any damage to computer systems or loss of data resulting from the download operations falls on the user and cannot be attributed to the manager.
The manager declines all responsibility for any damage resulting from inaccessibility to the services on the sites or from any damage caused by viruses, damaged files, errors, omissions, service interruptions, deletion of contents, problems connected to the network, providers or telephone connections and / or telematic, to unauthorized access, to alteration of data, to the failure and / or faulty functioning of the user’s electronic equipment.
The User is responsible for the custody and correct use of his personal information, including the credentials that allow access to the reserved services, as well as for any harmful consequence or prejudice that may arise for the manager or third parties as a result of the incorrect use, loss, theft of such information.
The Manager has taken all reasonable precautions to prevent content and images from being published on the site that may be deemed to be detrimental to the dignity, human rights and dignity of persons, in all possible forms and expressions. In any case, if the aforementioned contents are considered harmful to religious or ethical sensitivity or decorum, the user is requested to communicate this condition to the manager, who nevertheless warns that any access to contents considered harmful or offensive takes place by the user at their sole discretion and at their sole and personal responsibility.
The Manager has also taken every useful precaution to ensure that all information on the sites is correct, complete and up-to-date, however the same does not assume any responsibility towards users for the accuracy and completeness of the content published on the sites, unless otherwise provided by law. Art. 5 – Personal account
The User may have the opportunity to register on the sites or services connected to it to use their services. The User may have access to an area or service exclusively dedicated to the same through which he can access and can check the status of the services and / or his / her data.
By registering on the sites and / or related services, the user must provide an e-mail address and / or a username (hereinafter the “id”) and / or a strictly personal access password. Both the ID and the password cannot be used by two or more workstations at the same time and the user will not be able to assign or transfer them to third parties, except under his full responsibility. In this regard, please note that the user will be held liable to the manager and any third party for all actions, transactions and / or events that have occurred and / or carried out through the use of the entered ID and / or password.
The User is obliged to preserve the confidentiality and secrecy of his id and password and is required to promptly inform the sites of any unauthorized use or loss, by e-mail or registered post so that the same can suspend the provision of its services with reference to the account.
If unauthorized access to the user’s account has occurred and / or the same has lost his ID and / or password for more than three times, the manager reserves the right to remove the user’s account. without the latter having anything to claim against the manager.
The manager cannot be held responsible in any way, directly or indirectly, in any form or on the basis of any liability regime, for any kind of injury or damage resulting from, or related to, the user’s failure to comply with the provisions referred to in this article.
The manager will be free to inhibit the access of a user to his own reserved area and / or to interrupt the operation of the ID and / or password of the same, if he considers that a substantial violation of these general conditions of use has occurred and specifically what is stated below, or if the user makes an illicit or incorrect use of the services of the sites.
The User will also be required not to carry out nor to allow or allow third parties the following behaviours (not exhaustive and constantly updated):
– the uploading or creation within the reserved area of any data or content that is in violation of any law, regulation or right of third parties (including, among others, trade secrets or personal data of third parties);
– the use of services for purposes other than mere access to them in the manner in which they are provided by the manager;
– carry out actions of any kind and / or nature aimed at bypassing, deactivating or interfering in any way with the applications related to the safety of the site services or other applications that prevent, limit or restrict the use or copy of any material present on the same;
– use of the site services for any illegal purpose or in violation of any applicable legislation;
– interfere with or damage the services and systems of the sites or their relative use by any user, by any means, including by uploading files or otherwise disseminating viruses, adware, spyware, bugs or other harmful electronic tools;
– carry out actions aimed at bypassing tools for the exclusion of robots or other measures that the sites may use to prevent unauthorized access to their services.
Art. 6 – Exclusion of liability
As indicated above, the manager carries out with the utmost diligence the care and maintenance of the sites and their contents, however, assumes no responsibility for the correctness, completeness and timeliness of the data and information provided on the sites or on the sites linked to them. Therefore, any liability for errors or omissions resulting from the use of data and information on the sites must be excluded.
The manager declines all responsibility, including the presence of errors, the correction of errors, the responsibility of the server hosting the sites; he is also not responsible for the use of the information contained, their correctness and reliability. In no case, including negligence, the owner will be responsible for any direct or indirect damage that may result from the use, or the incapacity to use the materials on the sites.
Art. 7 – Limitations on the provision of the service
The manager cannot be held responsible for damage resulting from the failure to provide the service due to the incorrect or non-functioning of electronic means of communication for reasons beyond the sphere of its foreseeable control. By way of example, but not limited to, the malfunction of servers and other electronic devices even if they are not an integral part of the Internet, malfunction of installed software, computer viruses on the possible presence of viruses or other harmful and harmful computer components, as well as from actions of hackers or other users with access to the network. The user therefore undertakes to indemnify and hold harmless the owner from any liability and / or request in this regard.
Art. 8 – Links to other sites
The sites may contain hyperlinks to other websites that have no connection with the same. The operator does not control or monitor these websites and therefore does not guarantee their content or data management in any way. The user must therefore carefully read the conditions of use of the third party sites visited and the related privacy policies, as these conditions of use and the privacy policy refer only to these sites.
Art.9 – Links in other web pages
These sites can also be reached through third party sites where there will be a link or banner to access the sites.
The activation of links on third party sites to these sites is possible only with the consent and authorization of the manager, which can be requested by contacting the same at the aforementioned address, or by writing to the email address: unioneinduista@induismo.it
The activation of unauthorized links will legitimize the manager to act for the immediate deactivation of illegitimate links and for the eventual recognition of the related commercial practice or unfair competition or action to the detriment of the name and reputation of the manager, his services and of the companies of the same group. In any case, the activation of deep hypertext links (such as deep frames or deep links) to the sites or the unauthorized use of meta-tags is prohibited.
Art. 10 – Trademarks
All trademarks and distinctive signs present on the sites, also relating to the individual activities carried out by the owner, are exclusive to the owner himself or to the companies referring to him.
The owner has the right to make exclusive use of the aforementioned trademarks. Therefore, any unauthorized and / or non-compliant use of the law is strictly prohibited and entails legal consequences. It is in no way allowed to use the trademarks and any other distinctive sign present on the sites to unduly, even indirectly, take advantage of the distinctive character or reputation of the owner’s trademarks or in such a way as to harm them and their owners.
The domains dipavali.it, dipavali.org, giornointernazionaledelloyoga.it, hinduism.it, induismo.it, internationaldayofyoga.it, teofonia.it, unioneinduista.it and related subdomains as well as the various declinations are the property of the owner. No use, even indirect, is permitted, unless specifically authorized in writing by the owner or owners.
Art. 11 – Age limits
The quality of the content, the high educational and cultural profile of the materials on the sites make them suitable for consultation even by an audience of minors, with the consent of the parent or guardian, in accordance with the legislation applicable to them.
Art 12 – Indemnity
The user undertakes to release from liability the manager (as well as its representatives, administrators, partners, employees, collaborators, volunteers) from any obligation or liability, including any legal costs of defense in court that may arise from damages caused to users or third parties in relation to the content uploaded online, the violation of the terms of the law or of these conditions of use.

User data is processed in accordance with the provisions of the legislation on the protection of personal data, as specified in the appropriate section containing the information pursuant to art. 13 EU Regulation 2016/679 (Privacy Policy). Art. 14 – Ineffectiveness and partial nullity
Should any clause of these terms of use be cancelled, invalid or ineffective, the aforementioned clause will be eliminated while the remaining clauses will remain fully effective.
Art. 15 – Jurisdiction
For any dispute concerning these conditions of use of websites and disputes relating to the execution, interpretation and validity of this contract, the court of Rome is competent.
